The Definitions and Laws of Gambling

To understand how North Dakota evaluates and polices gambling, you have to first examine how they define it. Within this state, it is as follows:
“Risking any money, credit, deposit, or other thing of value for gain, contingent, wholly or partially, upon lot, chance, the operation of gambling apparatus, or the happening or outcome of an event, including an election or sporting event, over which the person taking the risk has no control.”

By this definition alone, the state technically outlaws table games such as baccarat and roulette. At the same time, the characterization of the term “apparatus” also prevents the use of equipment such as slot machines.

Nonetheless, the gambling legislation does go onto make an exception in the instance of: “Lawful contests of skill, speed, strength, or endurance in which awards are made only to entrants or to the owners of entries.”
So, technically, you can argue that you can play casino games as long as they require a skill. There then may be some leeway to these gambling regulations. Of course, you will first have to check with an attorney before making such assumptions.

The Exceptions to the Rule

As mentioned, the laws surrounding gambling in ND isn’t as simple as you would imagine. Technically, most commercial forms of gambling are not allowed within the state. Therefore, if you wanted to set up casinos or some kind of gaming centre, you would not be permitted to do so.

This doesn’t mean, though, that all forms of casinos are banned within North Dakota. To begin with, there are tribal lands within the area. Since these lands fall under a slightly different purview, they have a little bit more freedom as far as North Dakota state casinos are concerned. Thus, gambling activities are legal within the confines of these reservations.
This is the list of casinos in North Dakota:

  • 4 Bears Casino
  • Dakota Magic Casino
  • Grand Treasure Casino
  • Grand River Casino
  • Spirit Lake Casino
  • Prairie Knights Casino

There are age restrictions in each of these casinos. If you simply want to play bingo, then you will have to be at least 18 years of age. In case you want to engage in other gambling activities, though, the legal gambling age in North Dakota is 21.

Social Gambling Within North Dakota

To make matters even more complicated, North Dakota allows what is known as “charitable gambling”. In short, if the activities that you are hosting will result in gifts or money for charitable causes, then it is considered legal gambling. Of course, it isn’t quite as simple as that.

Individuals who wish to take this path have to receive a license from North Dakota before they can proceed and allow people to play for real money. Even with this permission, there are numerous restrictions placed on such gambling events. This includes how much cash you can bet and even the types of games that you can play.

Also, what can be considered a charitable organization is limited to the following definition: “an organization whose primary purpose is for relief of poor, distressed, underprivileged, diseased, elderly, or abused persons, prevention of cruelty to children or animals, or a similar condition of public concern.”

Placing Bets on Sports

Currently, residents of North Dakota are only allowed to place bets on horse and greyhound races. Nonetheless, they do have a few advantages over their neighbours, though, since they have a greater number of options to choose from. This includes pari-mutuel, place, show, quinella, and combination as well.

The downside is that other forms of sports betting have yet to be legalized. The North Dakota government does attempt to put forward a bill every now and then but it doesn’t get very far. Thus, this form of wagering is still in development.

Online Gambling Within North Dakota

When it comes to online wagering, there is both good news and bad news. Online gambling North Dakota was actually rather popular within the region. So much so that lawmakers actually tried to legalize online operations some time ago.

Unfortunately, this happened at a time when most North Dakota authorities didn’t fully appreciate the internet or how much it could bolster the local economy. Thus, these changes to the North Dakota online gambling laws never came about.

This doesn’t mean that all hope for online gambling ND is lost, however. While the legislation doesn’t state that North Dakota online gambling is legal, it doesn’t actually outlaw it completely, either. Due to this, there is some wiggle room for those interested in online casinos.

What Sites Can You Play On?

While you can still gamble online in the state, you do have to be careful about which sites you select. There aren’t any online casinos in North Dakota state. Since the government doesn’t support such online activities as yet, there aren’t any regulated North Dakota online casinos available.

This means that if you were to search, “is online poker legal in North Dakota” you would receive a vague reply. Therefore, if you live within the USA, then you will need to consider offshore casinos. These are out of the reach of the local authorities and so, you don’t have to be concerned about breaking any rules.

So, if you were to look up, “is Bovada legal in North Dakota”, you will discover that you can safely play in such online casinos. Here, you will be able to dabble in online slots and play a wide variety of online table games. The only rules that you will have to abide by are the ones that are set out by the casino, online.

Of course, since these online casinos are hosted in a different location, there are a few points to be aware of. For instance, you will need to find casinos that cater to American players specifically. This can easily be done by reading the online terms and conditions of each casino.
It is also best to always select trustworthy sites that have been operating online for a while. Checking out reviews online can be a huge help in figuring out which online casinos are good and which ones that you should stay away from.

Trying to figure out the wagering laws in North Dakota is no easy task. They can be complex, outdated, and outright confusing. Hopefully, though, you now have some more insight into them. At the very least, you are now aware of the online casinos available to you. Thus, even if your land-based endeavours don’t pan out, there is still a lot more playing that you can do. It is simply a matter of finding the right offshore casino from our RTG casinos online list for you and your wagering needs.

North Dakota is the last place you’d expect to have much of a gambling presence. After all, they have less than 740,000 residents, low population density, and a frigid climate.

But despite all this, the Roughrider State has become a large gambling hub with 27 gaming establishments.

Most of the gaming action centers on 6 tribal casinos and nearly two dozen charitable businesses.

But they offer just about everything else too, including charitable gambling, social gaming, pari-mutuel wagering, and a lottery. Bars and restaurants can also offer video lottery games.

Let’s continue discussing the North Dakota gambling scene by looking at key stats, laws, where you can gamble in the Peace State, and their stance on internet gaming.

The lion’s share of North Dakota’s gambling revenue comes from charitable establishments, which generate close to $200 million annually. Their charity gaming revenue ranks among the highest in America.

The catch is that much of this goes to charity, their employees, and operational costs. North Dakota only taxes charity casinos at a rate of 1%, meaning just $2 million goes towards the state.

The Peace State is last among per-capita lottery sales in states that offer a lottery, selling $38 in tickets sales per resident. This works out to roughly $28 million in total sales, and 22% of this ($6.2m) goes towards the state’s General Fund.

A big reason why North Dakota’s lottery sales are lower than fellow US states is because they don’t offer scratch-off tickets. They’re also unique in that they don’t sell in-state tickets, instead offering multi-state jackpot lotteries (i.e. Mega Millions, Powerball).

Another hit against North Dakota’s gambling revenue is that they don’t tax tribal casinos. Instead, these casinos only cover their regulatory fees, which amount to just over $260,000 collectively.

As you can see, gambling isn’t a huge boon for North Dakota, despite all the betting that goes on in their state. But at least the numerous gaming establishments provide employment for many residents.
