1. DESCRIPTION OF SWEEPSTAKES:

The Hot Dog Costume Contest (the “Sweepstakes”) is a random drawing promotion comprised of $312 in prizes.

2. SWEEPSTAKES PERIOD:

The Sweepstakes begins on October 9, 2017 and ends on October 31, 2017 (the “Sweepstakes Period”). The Sponsor’s computer is the official timekeeping device for this Sweepstakes.

3. ELIGIBILITY:

Open to legal U.S residents of the fifty (50) United States and the District of Columbia and Puerto Rico who are 18 years of age or older at time of entry. Void where prohibited by law. Employees, agents, successors, and assignees of Smithfield Packaged Meats Sales Corp. and its parents, subsidiaries, affiliates, advertising agencies and promotional companies involved in the Sweepstakes (collectively, the “Promotional Entities”), as well as the family and household members of same (including spouses, parents, step-parents, grandparents, children, step-children, grandchildren), shall be ineligible to participate in the Sweepstakes and shall be ineligible for any prize covered herein. 4. HOW TO ENTER:

During the Sweepstakes Period, tag @OriginalNathans on Instagram or Facebook with a photo of themselves (either alone or in a group/family) dressed as a hot dog and tag the photo with the hashtags #NathansFamous and #HotDogHalloweenContest. No purchase is necessary to enter or win.

5. SELECTION OF WINNERS:

One winner will be selected randomly from among all eligible entries received during the Sweepstakes Period. Sponsor or Sponsor’s promotional agent will conduct a random drawing (“Drawing”) on or about the business day after the conclusion of the Sweepstakes Period. Odds of winning depend on the number of eligible entries received at the time of the Drawing. The potential prize winner will be notified via the method of entry (for example, direct message to their Instagram account if winning entry is an Instagram post). If a prize winner notification or a prize is returned as undeliverable, a potential prize winner is ineligible, a prize winner declines a prize, or a potential prize winner does not respond to Sponsor’s prize winner notification within forty-eight (48) hours after notification, the prize may be forfeited and awarded to an alternate winner in a random drawing from among all remaining eligible entries.

9. GENERAL TERMS AND CONDITIONS:

By participating in this Sweepstakes, entrants and prizewinners agree to be bound by these Official Rules and the decisions of the Sponsor and Promotional Entities, which are final in all respects and not subject to appeal. By participating in the Sweepstakes, entrants and prize winners agree to release, discharge, indemnify and hold harmless the Promotional Entities, Nathan’s Famous, Inc., Facebook, Inc., and each of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) from and against any claims made by any entrant, prize winner, or any other third parties, related in any way to the operation of this Sweepstakes as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from receipt, acceptance, possession, misuse or use of a prize or participation in any promotion related activity or participation in this Sweepstakes. This Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with, Facebook or Instagram.

11. DISPUTES:

Except where prohibited, each entrant agrees: (i) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the federal or state courts in the State of Illinois; (ii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, excluding attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain an award for, and each entrant hereby waives all rights to claim, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses.
